Types Of Law Courts in Saint Vincent And The Grenadines

In Saint Vincent and the Grenadines, the legal and judicial system is based on English Common Law and includes several levels of courts. The country is part of the Eastern Caribbean Supreme Court (ECSC) system, which serves multiple countries in the region. Here’s a breakdown of the types of law courts in SVG:


Types of Law Courts in Saint Vincent and the Grenadines

1. Magistrate’s Courts (Lower Courts)

  • Handle less serious (summary) criminal offenses, minor civil claims, traffic matters, and preliminary hearings.
  • Also deal with:
    • Family matters (e.g. maintenance, custody)
    • Liquor licenses
    • Employment disputes
  • Presided over by a Magistrate (no jury involved).

2. High Court (Supreme Court)

  • Handles serious criminal cases, major civil disputes, divorce and family law, constitutional matters, and probate issues.
  • Part of the Eastern Caribbean Supreme Court (ECSC).
  • Presided over by a High Court Judge.
  • Can conduct jury trials in criminal matters.

3. Court of Appeal

  • Also part of the Eastern Caribbean Supreme Court.
  • Hears appeals from the High Court and sometimes Magistrate’s Courts.
  • Decisions made by a panel of three appellate judges.
  • Does not conduct trials—only reviews judgments for errors in law or procedure.

4. Privy Council (UK) – Final Court of Appeal

  • SVG’s final court of appeal is the Judicial Committee of the Privy Council in London.
  • This is instead of the Caribbean Court of Justice (CCJ), which some CARICOM nations use.
  • Handles appeals on major civil or criminal matters after all local avenues have been exhausted.

5. Family Court (Specialized Division)

  • A specialized branch that may be operated under the Magistrate or High Court level.
  • Deals with:
    • Child custody and maintenance
    • Domestic violence
    • Child protection
  • May involve social services and legal aid support.

6. Juvenile Court

  • Handles cases involving minors under a certain age (usually under 16 or 18).
  • Often integrated within the Magistrate’s Court system with special procedures to protect minors.

7. Commercial Court (Regional – under ECSC)

  • SVG doesn’t have a standalone commercial court, but the Eastern Caribbean Supreme Court provides commercial dispute resolution through its regional commercial division, especially for cross-border or investment disputes.

  1. Magistrate’s Court – First level (minor cases)
  2. High Court – Major civil/criminal cases
  3. Court of Appeal – Regional appellate court
  4. Privy Council (UK) – Final appeal
